Art.1 The vehicles shall only be rented to persons who own valid national or international driving licence for at least 3 years and over 23 years of age at the date of rental of the car.
Art.2 The necessary documents for reting are:
In the original: driving licence, parssport, bulletin or identity card;
Art.3 The rate payment will be made in LEI, at the BNR echange rate on the day of payment
Art.4.1 When renting, the client must provide a warranty corresponding to the rented car class, according to the list of displayed prices as well as the cost of the rental itself.
Art.4.2 The warranty is used to cover the damage to the vehicle caused by the customer's fault.
Art.4.3 The warranty will be fully refunded if the rented vehicle is returned to the date and time fixed in the contract with all of the items listed in the inventory without any internal or external damage and other non-collateral damage occurring during the contract period.
Art.5 The liability of the client in the event of an accident, loss of inventory items or damage to goods inside the car is within the warranty coverage of the car, unless the damages are produced within the limits of the insurance.
Art.6 The rental rate includes:
Art.6.1 300km/day limit, VAT, RCA, vignette(rovinieta), Casco insurance;
Art.6.2 Replacement of the defective car, except in the case of fault caused by the fault of the customer;
Art.6.3 Up-to-date technical periodic revisions and maintenance of the car;
Art.6.4 Support number: +40744802000.
Art.6.5 Exceeding the 300 km/day limit is additionally charged with 0.1 EURO/km.
Art.7 Rental rate don't include:
Art.7.1 Fuel, transit fees, garage, transhipment during rental;
Art.7.2 Insurance for persons and luggage in the car.
Art.7.3 Fines due break of the law by the client.
Art.8 Other rates in the following situations:
Art.8.1 Taxable child seat: 3 EURO, snow chains rate: 3 EURO, GPS rate: 3 EURO/day
Art.8.2 Making a driver available for a period of less than or equal to 8 hours a day is charged 30 EURO/day;
Art.8.3 Delivering the car to a location other than the one where it was rented is charged 0.5 EURO/km.
Art.8.4 Refueling the vehicle is charged 2 EURO/liter;
Art.8.5 Exceeding the time for returning the car with more than 2 hours without the announcement of the Company in advance is charged as a full day according to the contract;
Art.8.6 In order to determine the lack or damage of the inventory objects mentioned in the contract, the Company reserves the right to restrain, totally or partially, the value of the warranty;
Art.9 The client has the following obligations:
Art.9.1 To pay, upon conclusion of the car rental contract, the consideration of the rental period and the related guarantee;
Art.9.2 keep the car in a technical state appropriate to the one it had at the date of conclusion of the lease;
Art.9.3 Know and obey applicable traffic laws;
Art.9.4 Use the rented car only on public roads;
Art.9.5 Provide the appropriately leased vehicle against theft, vandalism or destruction;
Art.9.6 Not to carry passengers for money or other material rewards;
Art.9.7 Not to use the rented car in legal, illegal or training for car racing;
Art.9.8 Not to trail other vehicles;
Art.9.9 Do not damage the underside of the rented car by action or negligence;
Art.9.10 Require written authorization to leave the country with the rented car with at least 48 hours before the scheduled departure date;
Art.9.11 Do not leave the rented car on the territory of Romania without written authorization from SC Auto Data Rental SRL; if the customer leaves the territory of Romania, this will be illegal, the entire liability lies with the client, including for the damage caused by accident, theft or the return of the car;
Art.9.12 Obey the path stated in the mandate;
Art.9.13 Not to entrust or lease the car to third-party persons;
Art.9.14 Stop the trip and announce the representatives of SC Auto Data Rental SRL at NON STOP number +40744802000 in case of signs of malfunctioning of the car and which may endanger the technical condition of the car or the conditions in the road traffic;
Art.9.15 Do not engage in repairs or other work on the rented car without the written approval of the representatives of SC Auto Data Rental SRL; the amounts paid by the customer for maintenance or technical revisions due in the course of time or for some repairs that are not attributable to them, are compensated by SC Auto Data Rental SRL on the basis of the documents evidencing the performance of these works: the tax invoice and the receipt with the company data;
Art.9.16 Do not cause damage to the outside, interior or wheel, intentionally or negligently, by inappropriate use;
Art.9.17 Return the rented car at the date, time and location stipulated in the contract; the extension of the rental period can be done only with the written approval of SC Auto Data Rental SRL; the use of the car over the rental period without prior written approval for this purpose constitutes an act of misappropriation of the property and is sanctioned in accordance with the legislation in force.
Art.10 Failure to comply with the aforementioned obligations results in the termination of the effect of the insurance and the liability for damages is entirely due to the client, including the unrealized income during the period of immobilisation of the rented car.
Art.11 In case of an accident, the client is obliged to:
Art.11.1 Take all measures to limit the damage caused;
Art.11.2 Tell the nearest police authority, within the district where the accident occurred, in order to ascertain the accident and make the legal forms; announce the representatives of SC Auto Data Rental SRL, under the assistance number +40744802000, within 2 hours of the accident;
Art.11.3 Obey the road rules on leaving the accident site;
Art.11.4 Obtain a copy of the driver's bulletin and driving license, such as a written statement and a copy of the RCA;
Art.11.5 Procure repair authorization from competent authorities.
Art.12 This contract is an executory title value, the client expressly and irrevocably accepting the surrender of the good to the company without notice, prior notice or process.
Art.13 Any dispute arising out of or in connection with this Agreement, including its validity, interpretation, execution or termination, shall be settled amicably in advance and, if not, by the courts of Cluj-Napoca.
Art.14 The litigation in question will always be settled in accordance with Romanian law.
Art.15 SC Auto Data Rental Ltd retains the right to recover from the user or customer the damages incurred in excess of the warranty in cases where the customer or the user violates the obligations of this contract in accordance with the laws in force.
Art.16 By signing this contract, the client acknowledges that he has read, understands and agrees these rental conditions as an integral part of the contract.
Art.17 The client has the obligation to hand over the clean car so that it can be checked. The warranty is unblocked only after verification.
